Fair Pay and Safe Workplaces
·Barack Obama·79 FR 45309
Directs federal agencies to require companies bidding on government contracts over $500,000 to disclose labor law violations from the preceding three years, covering laws such as the Fair Labor Standards Act, the Occupational Safety and Health Act, the National Labor Relations Act, and several anti-discrimination statutes, among others. Contracting officers must weigh this history, along with any corrective steps taken, when deciding whether a company is a responsible contractor, and must continue monitoring compliance during the contract, with similar disclosure rules extended to major subcontractors. Each agency must designate a Labor Compliance Advisor to oversee these reviews and coordinate with the Department of Labor. The order also requires contractors to give workers wage statements each pay period and to disclose independent-contractor status, and bars contractors on contracts over $1 million from requiring workers to arbitrate civil rights or sexual assault/harassment claims without their voluntary post-dispute consent.
