Educational Excellence for Hispanic Americans

Establishes the President's Advisory Commission on Educational Excellence for Hispanic Americans within the Department of Education, made up of up to 25 members appointed by the President, to advise the President and the Secretary of Education on Hispanic Americans' progress toward national education goals and on federal efforts to improve their educational outcomes. Creates the White House Initiative on Educational Excellence for Hispanic Americans, an interagency working group led by a senior federal official, to support the Commission and coordinate related programs across agencies. Directs executive departments and designated agencies to appoint liaison officials and share relevant data, and requires the Secretary of Education, with the Commission's input, to submit an Annual Federal Plan detailing agency efforts and measurable objectives to increase Hispanic American participation in federal education programs. Directs the Office of Personnel Management, in consultation with the Secretaries of Education and Labor, to develop a program recruiting Hispanic students for government positions. Establishes, under section 9A of the Railway Labor Act, a second emergency board of three presidentially appointed members to investigate a labor dispute between The Long Island Rail Road and employees represented by the United Transportation Union, after a first board's recommendations were not accepted. Board members may have no financial interest in any railroad or railroad labor organization. The order requires the parties to submit final settlement offers within 30 days of the board's creation, and the board to report to the President within 30 days after that, identifying the most reasonable offer. It also bars the parties from changing the conditions that caused the dispute, except by mutual agreement, from the time the board was requested until 60 days after its report is issued. Sets a schedule for agencies to develop, outline, and finalize agency-wide environmental justice strategies over 4 to 24 months, and requires a report to the President within 14 months. Directs agencies to improve research, data collection on race, national origin, and income near affected facilities, and study subsistence consumption of fish and wildlife. Agencies must submit initial implementation plans to the Director of the Office of Management and Budget by March 15, 1994, consistent with OMB Circular A-94. Starting with the fiscal year 1996 budget submission, agencies must use these principles to justify major infrastructure programs, defined as those with annual budgetary resources exceeding $50 million. From March 15, 1994 onward, agencies must also apply these principles when seeking OMB clearance for legislative proposals authorizing infrastructure programs. The Office of Management and Budget is directed to provide implementation guidance. Requires the Secretary to issue implementing regulations, and requires other agencies to follow with their own proposed and final regulations within set timeframes after the Secretary's rules are published. Establishes procedures for referring and investigating discrimination complaints, coordinating with the Attorney General, and imposing sanctions such as contract termination or withdrawal of aid for noncompliance. Revokes Executive Order 12259 and portions of Executive Order 11063, transferring related functions to the Secretary of Housing and Urban Development and updating nondiscrimination language. The Committee is to review the ethical and scientific standards applied to government-run or sponsored human radiation experiments conducted between 1944 and May 30, 1974, including specific named tests at Hanford, Oak Ridge, Dugway, and Los Alamos, and may sample later experiments to decide if further inquiry is warranted. It may recommend notifying affected subjects or descendants of health risks, propose further policy standards, and request agency cooperation and information.
