Plain-language summary

Auto-generated summaryWritten by claude-sonnet-5 from the order’s own text · prompt v4 ·

Sets an order of succession within the Department of Defense, listing eighteen tiers of officials, from the Deputy Secretary of Defense through Assistant Secretaries and General Counsels of the Military Departments, who would act as Secretary of Defense if the Secretary dies, resigns, or otherwise cannot perform the office's duties. Precedence among officials in the same tier is determined by appointment date or, if identical, by the order in which they took their oath. Officials serving only in an acting capacity cannot act as Secretary under this order, and only individuals appointed with Senate confirmation and otherwise eligible under the Federal Vacancies Reform Act of 1998 may serve. The President retains discretion to depart from this order when designating an Acting Secretary. Revokes Executive Order 13533 of March 1, 2010, which previously set the department's succession order. States that it creates no enforceable legal rights for any party.

Claimed authority

By the authority vested in me as President by the Constitution and the laws of the United States of America, including the Federal Vacancies Reform Act of 1998, as amended, 5 U.S.C. 3345 et seq., it is hereby ordered

Quoted from the order as written. Many orders cite nothing more specific than “the Constitution and the laws”; this reproduces what the order claims, not an assessment of whether it holds.

Disposition

Revokes: EO 13533, March 1, 2010

Compiled after the fact by the National Archives, so recent orders often have none yet. An empty disposition means no record, not no activity.
