Plain-language summary

Auto-generated summaryWritten by claude-sonnet-5 from the order’s own text · prompt v4 ·

Amends Part 6 of Title 33 of the Code of Federal Regulations, which implements Executive Order 10173 on safeguarding vessels, harbors, ports, and waterfront facilities. Adds a new definition of "Area Commander" as the Coast Guard officer designated by the Commandant to command a Coast Guard Area. Revises the enforcement section to specify that regulations under this part are enforced by the Captain of the Port under the supervision of the District Commander, Area Commander, and Commandant, with the same authority vested in and exercisable by those officers, and extends enforcement authority to other Coast Guard officers or petty officers designated by them. States that any such authority remains subject to the direction of the Secretary of the department in which the Coast Guard operates. The order cites continuing security concerns arising from disturbances in international relations since the September 11, 2001 attacks as justification.

Nothing appears in this space without a citation to a court action or a cited precedent. An order with no such record is described as untested, never as likely or unlikely to survive.

Claimed authority

By the authority vested in me as President by the Constitution and the laws of the United States of America, including section 1 of title II of the Act of June 15, 1917, as amended (50 U.S.C. 191) (the “Act”), and in addition to the finding in Executive Order 10173 of October 18, 1950, and any other declaration or finding in force under section 1 of the Act

Quoted from the order as written. Many orders cite nothing more specific than “the Constitution and the laws”; this reproduces what the order claims, not an assessment of whether it holds.

Disposition

See: EO 10173, October 18, 1950

Compiled after the fact by the National Archives, so recent orders often have none yet. An empty disposition means no record, not no activity.
